2024 TURKISH AIRLINES EUROLEAGUE FINAL FOUR FAN ZONE CONCERTS

TERMS AND CONDITIONS

The 2024 Turkish Airlines EuroLeague Final Four Fan Zone Concert (the “Concert”) is a live music event that will be held at the Fan Zone of the 2024 Turkish Airlines EuroLeague Final Four Berlin. The Concert, which is organized by Euroleague Ventures S.A. with registered address at 60 Grand-Rue, L-1660 Luxembourg, and VAT number LU28609044 (hereinafter “Organizer”), is scheduled to take place during the Final Four weekend, on Saturday, May 25, 2024 at 21:00h in the Kraftwerk Venue in Köpenicker Str. 70, 10179 Berlin, Germany (the “Venue”).  

The following terms and conditions (the “Terms and Conditions”) apply to all ticket purchases of the Concert:

1. The Terms and Conditions incorporate and should be read in accordance with any Venue terms, conditions and regulations, copies of which are available upon request from the Venue.

2. Tickets will be emailed to the purchasers (hereinafter the “Customers”) once the purchase is confirmed, at the email address they provide during the purchase process. It is responsibility of the Customer to ensure that the information provided is accurate prior to making the purchase and to contact the Organizer at [email protected] in case that twenty-four (24) hours before the Concert the Ticket is not received.

3. The number of available Tickets for the Concert is limited and will be available to any Customer on a first-come first-served basis. Tickets may be restricted to a maximum number per Customer. Organizer will notify of any such restriction at the time of purchase. Organizer reserves the right to, without prior notice, cancel Tickets purchased in excess of this number.

4. Attendance to the Concert is subject to presentation of a valid Ticket, and full compliance of these Terms and Conditions. Failure to comply with the foregoing may result in the Ticket being void and prohibition to participate in the Concert or exclusion from the same, without the Organizer assuming any liability and without Customer being entitled to claim amount, refund, or damages of any kind.

5. Customer acknowledges and accepts that Organizer may use service providers throughout the sales process and the Concert. However, Tickets shall always remain the property of the Organizer. Tickets purchased at any vendor or platform that is not displayed on www.f4tickets.com will not be considered as valid, and therefore will not grant access to the Concert.

6. No liability of any kind shall attach to Organizer from the sale process or in connection with the sales platform. Any such claims shall be directed towards CTS Eventim according to its applicable terms and conditions.

7. Ticket’s final price includes the following:

a. Net Ticket Price

b. Local taxes

c. Services fee from the sales platform that may be up to 13,5%.

8. Tickets can only be purchased by an active credit or debit card with the CVC number or by wire bank transfer. Customer understands and agrees that in the event that Customer’s bank rejects payment of the purchase, Passes will not be allocated.

9. The sales platform may provide Customer with information on the currency exchange rates and the purchase price in euros. This information is provided for information purposes only. Credit card issuing bank will apply its own currency exchange rated (if applicable) and may levy additional fees or charges for such transaction. Customer shall contact their respective credit card issuing bank before purchasing a Ticket in order to enquire about the credit card issuing bank’s exchange rates, charges or fees. Neither Organizer or the sales platform shall be responsible for any such exchange rates, fees or charges levied by the credit card issuing bank.

10. Minors (under the age of 18) are allowed to attend the Concert provided that 1) they are in possession of a valid Ticket, and 2) they are accompanied by an adult in possession of a valid Ticket. The Organizer’s recommendation is that children under 36 months do not attend the Concert to the extent that the Organizer considers the Concert not suitable for them. However, if the Customer does wish to bring them, at its discretion, they can attend as long as they possess a valid Ticket to gain entry and there is a responsible adult of 18 and above in possession of a valid Ticket. The Organizer takes every precaution to try and ensure everyone has a safe and enjoyable time at the Concert. If the Customer decides to bring a children under 36 months, the Organizer would suggest against taking them into the most densely crowded areas, which include the large area in front of the stage, and would recommend Children are recommended the Children to wear hearing protecting if the Customer decides to bring them to the Concert. It is the Customer’s responsibility to check the suitability of the Concert for any children in its party regardless of official age restrictions, this includes considering the type of audience the Concert is likely to attract and whether such audience is a suitable environment for children in its party. Refunds will not be issued if any aspect of the Concert, including the behaviour of the other audience members, causes offence to the Customer or any children on whose behalf the Customer has purchased Tickets.  

11.  Lost, stolen or damaged Tickets are non-refundable, and no replacements are available. Defective Tickets may be reissued provided that the defect is solely and entirely attributable to Organizer or sales platform and the Customer has notified and sufficiently proved such circumstance to Organizer at least 48 hours before the Concert. No damages or compensation of any kind other than the applicable refund according to these Terms and Conditions (see Point 23 below) can be claimed by Customer in case that for whatever reason the Ticket cannot be reissued, or the Customer is eventually unable to participate in any Experience.

12. Resale of the Ticket is not permitted.

13. For security reasons, access to the Concert will be granted until 15 minutes after the scheduled start time of the main artist’s performance (see Ticket). Afterwards, Customers will not be allowed to access, and no refunds will be granted in these circumstances.

14. Customer is aware that attending the Concert has many hazards and risks of physical injury or illness and that no such hazards or risks can be fully eliminated. Customer attending the Concert voluntarily assumes all risk and danger of personal injury (including injuries resulting in death) or damages to its property or possessions and all hazards arising from, or related in any way to the Concert, whether occurring prior to, during or after the Concert, however caused. Other than in case of proved gross negligence by the Organizer directly resulting in personal injury or damages to Customers, Customers release, waive, discharge and covenant not to sue the Organizer from all liability to them, their personal representatives, assigns, heirs and next of kin, for any claim, causes of action, obligations, lawsuits, charges, complaints, controversies, damages, costs or expenses of whatsoever kind, whether direct or indirectly, in law or in equity, in contract or in torn arising out of or in connection with attendance to the Concert. Access to the Concert is permitted with a printed Ticket or with an e-Ticket (mobile ticket):

·       In the case of a printed Ticket (print@home), each Ticket shall be printed on a white DIN A4 paper sheet.

·       When printing, the Ticket should not be resized (otherwise the barcode will not be readable).

·       The barcode shall be displayed in a high-quality print.

·       No fold shall be made over the barcode and the paper sheet shall not come into contact with liquids.

·       It is highly recommended to use a laser printer or high-quality ink printer. Neither Ticketing Platform or the Organizer are responsible for the printing on a lower quality printer (resolution under 300dpi or Matrix printer), which may not enable access to the Venue.

15. The Ticket code allows access to the Concert only once. It is Customer responsibility to keep it safe and prevent it from being duplicated. Exit from the Venue and subsequent re-entry with the same ticket will not be authorized. In this sense, Customers leaving the Venue during the Concert will not be re-admitted.

16. Customers shall not bring any of the following items into the Venue: smoking materials, laser pens, fireworks, flare rockets, animals (except guide dogs), food and drinks, any item which may be interpreted as a weapon (including shard or pointed objects such as knives and scissors), or illegal substances, materials or attributes containing racist, xenophobic, politics or any other propaganda, gas sprays, oversized items (including suitcases, sports bags, backpacks and rucksacks), noise devices (including speakers, megaphones, and musical instruments such as trumpets), drones and other remotely controlled devices, radio receivers, laptops, helmets, balls, and flags and banners over 50x50 cm.

17. For the safety of people at the Concert, the Organizer and the Venue management reserve the right to conduct security searches as deemed appropriate to ensure that Customers are not in possession of any prohibited items. The inspection may include the review of the necessary documentation. Organizer reserves the right to confiscate any item (not only items listed above) which in the opinion of the Organizer or the Venue may be considered hazardous.  

18. Organizer reserves the right to refuse admission and/or eject Customer from the Concert (and may take appropriate action to enforce this right) in reasonable circumstances including without limitation: 1) for health and safety reasons; 2) if Customer behaves in a manner which has or is likely to affect the enjoyment of other customers at the Concert; 3) if Customer uses or displays threatening, abusive or insulting words or mannerisms or behave in a manner which may provoke breach of the peace; 4) if, in Organizer’s reasonable opinion, Customer appears to be acting under the influence of alcohol or drugs; 5) if Customer fails, when required, to produce proof of identity or age; 6) if Customer files to comply with Organizer or Venue’s security searches; 7) if Customer breaches these Terms and Conditions and 8) if the Ticket is void. No refunds will be given if Customer is refused entry or ejected from the Venue.

19. The duration set for the Concert is for reference only and may be subject to variations depending on the development of the Concert itself. Customer understands and accepts that duration, time, date (provided the new date is set during the Final Four weekend), and location of the Concert may be altered at the discretion of Organizer if so deemed reasonably necessary due to safety or security reasons, force majeure, or unforeseen complications including but not limited to inclement weather, road traffic problems, strikes or restrictions or limitations issued by competent authorities. No refund or compensation of any kind will be granted to Customers unless the overall Concert is Materially Affected rendering the same inoperable. For the purposes of these Terms and Conditions, Materially Affected shall mean a change which, in Organizer’s reasonable opinion, makes the Concert materially different to the Concert that purchasers of the Ticket, taken generally, could reasonably expect. Please note that the following are not deemed to be a material affectation: adverse weather conditions, changes of any supporting act, changes to key performing individuals of the band other than Alvaro Soler, curtailment of the event where the majority of the Concert is performed in full and delays to the starting of the performance of the Concert. Refunds will take place according to these Terms and Conditions.

20. Participants must follow the rules, protocols and guidelines instructed by the Organizer or the management of the Venue. Organizer reserves the right to restrict access to parts of the Venue.

21. All amounts paid in connection with the purchases of Tickets are non-refundable and non-creditable except as otherwise provided in these Terms and Conditions.

22. No refunds will be made if the Customer does not participate in the Concert or if the Customer leaves the Concert before completion of the same, whether voluntarily or involuntarily.

23. Tickets will not be refunded unless the Concert is cancelled before its start, rescheduled outside of the Final Four weekend or where the Concert is Materially Affected.

24. In case the Customer is entitled to a refund, under no circumstances will the Organizer be held liable for costs or amounts other than the applicable net Ticket price of the Ticket purchased. For the sake of clarity, Customer shall not be entitled to claim to the Organizer other expenses or damages of any kind. The refund issued by the Organizer will consist of the net Ticket price of the Ticket only and will be completed no later than 1 month after the request made by Customer is accepted. No refund of any services or card fees (if applicable) will be issued unless otherwise specified in the sales platform terms and conditions, available at https://f4tickets.com/en/terms/concert.

25. Organizer reserves the right to alter the price of any Ticket at tis sole discretion. If Customers have already purchased a Ticket and a cheaper Ticket becomes available, Organizer will be under no obligation to refund any portion of the Ticket purchased at the initial price.

26. Organizer is not responsible for loss, theft or damage to items or belongings of Customers prior to, during or after the Concert.

27. Queries shall be sent to [email protected]. Queries shall be sent in English or German. Organizer shall use its reasonable efforts to translate queries sent in other languages using an automatic translator however the response will in all cases be provided in English or German. No liability of any kind shall assert to Organizer for inaccurate responses in these cases.

28. Tickets cannot be used for any promotion, advertising, fundraising, auction, raffle or any other similar commercial or non-commercial purposes, or used as a prize (or part of a prize) in any contest, competition, promotional game of change, lottery, or sweepstake. Tickets used in breach of this shall be void with no right to a refund. Any unauthorised sale or transfer of a Ticket may be reported to the police.

29. Customer understands and accepts that given the particularities of the Concert, the Customer’s image may be recorded and included in audiovisual clips made by the Organizer, to publicly promote the Final Four and its ancillary activities, including the Concert in all Organizer digital platforms. By purchasing a Ticket and participating in the Concert, the Customer acknowledges and consents to being photographed, filmed or taped by Organizer and its affiliates (including but not limited to Euroleague Properties SA, and Euroleague Entertainment and Services SLU) and/or any third parties appointed thereby, which shall have the right  to use, broadcast, and publish and license for any use, including commercial or promotional purposes, without any requirement for payment of money or other form of consideration, the Customer’s voice, image and likeness by means of live or recorded video and/or audio display, broadcast or other transmission or recording, photographs  provided that any such use is in connection with the Concert or the Final Four. The Consumer can at any time withdraw his/her consent by informing the Organizer by sending an email to [email protected] his/her non-permission to capture his/her personal image during the concert. Customers can find more information about this processing activity in the Data Protection Notice.

30. Organizer shall not be liable for any loss, theft or damage to items confiscated according to these Terms and Conditions.

31. The use of professional equipment for recording or transmitting (by digital or other means) any audio, visual or audio-visual material within the Venue is strictly forbidden. Customers shall not bring any such equipment to the Venue. Any recording or transmitting equipment, unauthorised recording, tapes, films or similar items may be confiscated and/or destroyed by the Organizer. Any recording/photography made of the Concert or part thereof shall not be used for commercial purposes, and if it is made in breach of these Terms and Conditions it shall belong to Organizer and Customers agree to assign any and all rights in any such recordings/photography to the Organizer.

 

By purchasing a Ticket, the Customer acknowledges that has read, understood, and agrees to comply with these Terms and Conditions.

The Organizer reserves the right to change these Terms and Conditions at any time at its sole discretion. Organizer will notify Customers of any such change via an email sent to the address indicated when purchasing the Ticket. In case the change is substantial (i.e. materially affects the Concert), the Customer will have the right to withdraw the purchase already concluded and receive a refund according to these Terms and Conditions.  The applicable version of the Terms and Conditions is the one in force at the time of the purchase.

Should any provisions of the Terms and Conditions or the rules applicable to any of the specific Experiences be declared void, ineffective, illegal or unenforceable by any competent court, regulator or authority the remainder of these shall remain in effect as if such void, ineffective, illegal or unenforceable provision(s) had not been included and where required and/or permitted under applicable law, the invalid provision shall be replaced with a provision, which closely approximates the purpose of such invalid provision

The contract between the Customer and Organizer made in accordance with these Terms and Conditions will be deemed to have been made in Luxembourg.

Any breach of these Terms and Conditions or the rules applicable to the Concert, regardless of whether the breach results in the suspension or cancellation of the Concert, shall entitle Organizer, in addition to cancel and invalidate the Ticket of the infringing Consumer with no right to a refund, to claim him/her for damages caused as a consequence of said breach.

 

Data Protection Notice

WHO IS RESPONSIBLE FOR YOUR DATA?

All personal data submitted to us through the use of the Ticketing Platform for the Ticket purchase or your participation in the Concert will be included in a database property of Euroleague Ventures SA, with address at 60 Grand Rue, L-1660 Luxembourg, and CTS Eventim Sports GmbH, Hohe Bleichen 11, 20354 Hamburg, Germany (hereinafter “Eventim”)and manage by Euroleague Entertainment and Services SLU with address at Quatre Camins 9-13, 08022 Barcelona, Spain (hereinafter, “EES”).

The Organizer and Eventim are jointly controllers of your personal data. As the responsible entities for processing your data, the Organizer and Eventim ensures that the processing of the personal data you provide takes place in compliance with the provisions of the current legislation on data protection and in accordance with European General Data Protection Regulation 2016/679 (GDPR).

WITH WHAT PURPOSE DO WE PROCESS YOUR PERSONAL DATA?

The purposes of the processing will be to:

1. Manage your relationship with the Organizer and Eventim: which includes managing the Ticket purchase, post-sale service, billing and collection, fulfilment of accounting and tax obligations, execute the Terms and Conditions and inform you about the Concert.

2. Compliance and security control: guarantee compliance with applicable regulations and existing prohibitions, guarantee the security in the Venue and its surrounding area, including by means of video surveillance and advice and legal defence of the Organizer and Eventim. 

3. Provision of commercial communications: If you consent, the Organizer and Eventim will process your personal data to send you commercial communications about products, services, news, offers and contests around EuroLeague and its official sponsors and Eventim.

4. Promotion and diffusion of the Concert: given the particularities of the Concert, being organized as ancillary activities of the Final Four,  your image may be recorded and diffused with promotional and informative purposes.

 

WHAT IS THE LEGAL BASIS FOR THE PROCESSING?

The legal basis for the processing of your personal data is:

1. With respect to the management of your relationship with the Organizer and Eventim: the processing of your personal data linked to that purpose is strictly necessary to i) comply with a legal relationship between you and the Organizer/Eventim (Art. 6.1b GDPR), ii) to comply with the accounting and tax obligations (Art. 6.1c GDPR) and iii) the Organizer’s and Eventim’s legitimate interest (Art. 6.1f GDPR);

2. With reference to the Compliance and security control: The processing of your personal data linked to this purpose is strictly necessary in order to i) comply with the applicable legal obligations (Art. 6.1c GDPR), ii) ensure the public interest of all people who attend or participate in the Event (Art. 6.1e GDPR) and iii) the Organizer’s legitimate interest (Art. 6.1f GDPR);

3. Regarding the provision of commercial communications: Your own consent (Art. 6.1a GDPR) and the contractual relationship derived from the Tickets purchase (Art. 6.1b GDPR); and

4. With reference to the promotion and diffusion of the Concert: Organizer’s legitimate interest (Art. 6.1f GDPR).

WHAT TYPE OF DATA DOES THE ORGANIZER AND EVENTIM PROCESS?

The Organizer and Eventim process the personal data necessary to fulfil the aforementioned purposes, which are:

·       Name and surname;

·       State of residence;

·       Date of birth;

·       Identification document (passport for non-German citizens and ID card for German citizens);

·       Bank details linked to the credit or debit card purchasing the Tickets;

·       Image, voice and likeness; and

You guarantee that the personal data provided to the Organizer and Eventim for the purposes of the Tickets purchase is true and accurate.

HOW LONG DOES THE ORGANIZER AND EVENTIM KEEP YOUR DATA?

Your personal data will only be processed for as long as it is necessary, useful and relevant to fulfil the purposes we collected it for.

Upon termination of the contractual relationship, your personal data will be stored and properly blocked to the only effects of fulfilling the legal or contractual obligations that are of application during five (5) years or the time strictly necessary for this purpose.

Nevertheless, the data related to billing and accounting will be kept for a period up to ten (10) years from the accrual date of the Ticket purchase.

For the provision of commercial communications and promotion of the Concert, your personal data will be kept as long as you have not withdrawn your consent. You can oppose and/or withdraw your consent for this processing at any time.

In the scenario that the applicable regulations in Germany and recommendations from the health authorities require you to have a valid COVID passport certificate or to submit a negative PCR test to access the Venue, said information will be only shown to the Concert stewards, the Organizer/Eventim will not process or store this information, nor will create a file with it. 

WHO WILL RECEIVE YOUR DATA?

We may share your personal data with public organizations, judges, courts and, in general, competent authorities when we have the legal obligation to provide them and to some third-party services providers (which may be based outside the European Economic Area) as a consequence of the provision of services.

Please note that we will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the European Economic Area and under the GDPR. Euroleague Basketball follows strict criteria of selection of service providers in order to comply with their obligations in terms of data protection and undertakes to sign with them the corresponding data processing contracts and/or if required, the standard contractual clauses, through which they will impose, among others, the following obligations: apply appropriate technical and organizational measures, use the personal data for the agreed purposes and acting only on the documented instructions of the Organizer.

Euroleague Entertainment and Services SLU with address at Quatre Camins 9-13, 08022 Barcelona, Spain will process certain personal data to provide the contracted services in the role of data processors. 

WHAT ARE YOUR RIGHTS REGARDING THE PROCESSING OF YOUR DATA?

You can exercise, at any time, under the terms established by law, your rights of access, rectification or deletion of data, as well as request restrictions on the processing of your personal data, oppose its processing or request the portability of your data, by sending a postal communication to the address indicated above or by writing an e-mail to [email protected] or to [email protected].

In any case, you can file a complaint before the National Commission for Data Protection from the Grand-Duchy of Luxembourg and/or before any other competent data protection authority.
