TERMS AND CONDITIONS

The 2024 Turkish Airlines EuroLeague Final Four VIP Experiences (the “Experiences”) are a number of limited exclusive experiences which are organized by Euroleague Ventures S.A. with registered address at 60 Grand-Rue, L-1660 Luxembourg, and VAT number LU28609044 (hereinafter “Organizer”), and which are scheduled to take place during the Final Four weekend (i.e. from Friday 24th to Sunday 26th May 2024).

The following terms and conditions (the “Terms and Conditions”) apply to all purchases of Experiences:

1.      Passes will be emailed to the purchasers (hereinafter the “Customers”) once the purchase is confirmed, at the email address they provide during the purchase process. It is responsibility of the Customer to ensure that the information provided is accurate prior to making the purchase and to contact the Organizer at [email protected] in case that twenty-four (24) hours before the Experience the Pass is not received.

2.       The number of available Passes for each Experience is limited and will be allocated at the time of purchase on a first-come, first-served basis.

3.      Participation to the Experience is subject to presentation of a valid Pass and full compliance of these Terms and Conditions. Failure to comply with the foregoing may result in the Pass being void and prohibition to participate in the Experience or exclusion from the same, without the Organizer assuming any liability and without Customer being entitled to claim amount, refund, or damages of any kind.

4.      Customer acknowledges and accepts that Organizer may use service providers throughout the sales process and the Experiences. However, Passes shall always remain the property of the Organizer. Passes purchased at any vendor or platform that is not displayed on www.f4tickets.com will not be considered as valid, and therefore will not grant access to any Experience.

5.      Pass’s final price includes the following:

a.       Net Pass Price

b.       Local taxes

c.       System fee from sales platform (2.5 €).

6.      Passes can only be purchased by an active credit or debit card with the CVC number or by wire bank transfer. Customer understands and agrees that in the event that Customer’s bank rejects payment of the purchase, Passes will not be allocated.

7.      The sales platform may provide Customer with information on the currency exchange rates and the purchase price in euros. This information is provided for information purposes only. Credit card issuing bank will apply its own currency exchange rated (if applicable) and may levy additional fees or charges for such transaction. Customer shall contact their respective credit card issuing bank before purchasing a Pass in order to enquire about the credit card issuing bank’s exchange rates, charges or fees. Neither Organizer or the sales platform shall be responsible for any such exchange rates, fees or charges levied by the credit card issuing bank.

8.      No minors are permitted to participate in the Experiences where being of legal age is required. For the Experiences where minors are allowed to participate, they must be accompanied by an adult with a valid Pass.

9.      Lost, stolen or damaged Passes are non-refundable, and no replacements are available. Defective Passes may be reissued provided that the defect is solely and entirely attributable to Organizer or sales platform and the Customer has notified and sufficiently proved such circumstance to Organizer at least 48 hours before the Experience. No damages or compensation of any kind other than the applicable refund according to these Terms and Conditions (see Point 25 below) can be claimed by Customer in case that for whatever reason the Pass cannot be reissued, or the Customer is eventually unable to participate in any Experience.

10.  Resale of the Pass is not permitted.

11.  Customer is required to reach the Experience location at least fifteen (15) minutes in advance of the Experience start time. The Organizer reserves the right not to allow participation to Customers that arrive once the Experience has begun, which will result in the forfeiture of the Pass.

12.  Customer participates in the Experiences voluntarily. Customers acknowledge that they choose the level of participation they will give to the Experience and have the right and responsibility to limit their participation in the Experience if they have safety or other concerns. Customers understand and acknowledge that participating in the Experiences carries certain inherent dangers and hazards which cannot be totally eliminated, and which could result in bodily injury (including permanent disability, paralysis or death) illness or disease. Customers further understand that those risks may include but are not limited to inclement weather, loss or damage to personal property, food poisoning, personal injury or accidents resulting from outdoor activities or physical exertion, environmental risks, unforeseeable acts of nature, physical contact with others and the emotional effects of being in perceived risk. Customers understand that if they choose to participate in the Experience, they are voluntarily assuming all risks associated with such participation and are waiving and releasing all claims arising out of such participation against the Organizer.

13.  Should the Experience include food and/or beverages, the Customer shall communicate any food intolerances and/or allergies, and vegan and/or vegetarian requirements to the Organizer by e-mail at least 48 hours prior to the Experience. In this case, the Organizer will consult with the Experience provider whether it is possible to accommodate the menu and will inform the Consumer. Only in case that the request has been submitted within the above-mentioned deadline and the menu cannot be accommodated, the Consumer will have the right to ask for a refund according to these Terms and Conditions. The Organizer shall in no case be held responsible for any disease, disorder or illness resulting from allergies and/or intolerances.

14.  Customer is responsible to wear appropriate clothing and gear according to the type of Experience purchased. No items or clothing that encourages violence is permitted.

15.  Organizer reserves the right to prohibit participation or eject from an Experience without right to refund or compensation of any kind, any Consumer who  in the opinion of the Organizer or the individual delivering the Experience is likely to affect the enjoyment of other participant, uses threatening, abusive or insulting words or behavior or in any way provokes or behaves in a manner which may provoke a breach of a pleasant and friendly atmosphere (such as smoking where it is not expressly permitted by Organizer), or is under the influence of drugs or alcohol.  

16.  The duration set for the Experiences is for reference only and may be subject to variations depending on the development of the Experience itself. Customer understands and accepts that duration, time, date (provided the new date is set during the Final Four weekend), location and even content of the Experience may be altered at the discretion of Organizer or the individual delivering the Experience is so deemed reasonably necessary due to safety or security reasons, force majeure, or unforeseen complications including but not limited to inclement weather, road traffic problems, strikes or restrictions or limitations issued by competent authorities. No refund or compensation of any kind will be granted to Customers unless the overall Experience is severally affected rendering the same inoperable.

17.  The Organizer shall have the right to modify the merchandise items of the welcome bag to be received by the Customers (by other items of the same or higher value), subject to availability of the same. In no case the Customer shall have the right to request for a refund in case the merchandise items received vary from the items described in the Pass purchase process. 

18.  Participants must follow the rules, protocols and guidelines instructed by the Organizer or any individual in charge of delivering the Experience. In particular, Customers understand and accept that no image recording of any kind is permitted during the Experiences unless in the specific moments and areas as specifically permitted by the Organizer or the individual in charge of delivering the Experience.

19.  All amounts paid in connection with the purchases of Experiences are non-refundable and non-creditable against other Experiences different than the one effectively purchased except as otherwise provided in these Terms and Conditions.

20.  Experiences require a minimum of participants. Should this number not be met, the Organizer shall have the right to reschedule or cancel the Experience by notifying the Customers. In the event that an Experience is cancelled due to a lack of participants, the Customer will have the right to request a refund, according to these Terms and Conditions.

21.  No refunds will be made if the Customer does not participate in the Experience or if the Customer leaves the Experience before completion of the same, whether voluntarily or involuntarily.

22.  In the event the Organizer decides to cancel any of the Experiences before their start, Customers with a valid Pass will be entitled to claim a refund according to these Terms and Conditions. 

23.  In case the Customer is entitled to a refund, under no circumstances will the Organizer be held liable for costs or amounts other than the applicable Net Pass Price of the Pass purchased. For the sake of clarity, Customer shall not be entitled to claim to the Organizer other expenses or damages of any kind. The refund issued by the Organizer will consist of the Net Pass Price of the Pass only and will be completed no later than 1 month after the request made by Customer is accepted. No refund of any services or card fees (if applicable) will be issued unless otherwise specified in the sales platform terms and conditions, available at https://f4tickets.com/en/terms/experiences.

24.  Organizer is not responsible for loss, theft or damage to items or belongings of Customers during their participation in the Experiences.

25.  Queries shall be sent to [email protected]. Queries shall be sent in English or German. Organizer shall use its reasonable efforts to translate queries sent in other languages using an automatic translator however the response will in all cases be provided in English or German. No liability of any kind shall assert to Organizer for inaccurate responses in these cases.

26.  Passes cannot be used for any promotion, advertising, fundraising, auction, raffle or any other similar commercial or non-commercial purposes, or used as a prize (or part of a prize) in any contest, competition, promotional game of change, lottery, or sweepstake. Passes used in breach of this shall be void with no right to a refund. Any unauthorised sale or transfer of a Pass may be reported to the police.

27.  Customer understands and accepts that given the particularities of the Experiences, the Customer’s image may be recorded and included in audiovisual clips made by the Organizer, to publicly promote the Final Four and its ancillary activities, including the Experiences in all Organizer digital platforms. To this end, the Organizer will implement technical and operational measures to ensure at the maximum possible extent that only the image of the Customers who consent to this processing activity are recorded / photographed. By purchasing a Pass, participating in the Experience and consenting to this data processing activity, the Customer acknowledges and consents to being photographed, filmed or taped by Organizer and its affiliates (including but not limited to Euroleague Properties SA, and Euroleague Entertainment and Services SLU) and/or any third parties appointed thereby, which shall have the right  to use, broadcast, and publish and license for any use, including commercial or promotional purposes, without any requirement for payment of money or other form of consideration, the Customer’s voice, image and likeness by means of live or recorded video and/or audio display, broadcast or other transmission or recording, photographs  provided that any such use is in connection with the Experiences or the Final Four. The Consumer can at any time withdraw his/her consent by informing the Organizer by sending an email to [email protected] or the individual delivering the Experience his/her non-permission to capture his/her personal image during the Experience. Customers can find more information about this processing activity in the Data Protection Notice.

 

By purchasing a Pass, the Customer acknowledges that has read, understood, and agrees to comply with these Terms and Conditions.

The Organizer reserves the right to change these Terms and Conditions at any time at its sole discretion. Organizer will notify Customers of any such change via an email sent to the address indicated when purchasing the Pass. In case the change is substantial (i.e. materially affects the Experience), the Customer will have the right to withdraw the purchase already concluded and receive a refund according to these Terms and Conditions.  The applicable version of the Terms and Conditions is the one in force at the time of the purchase.

Should any provisions of the Terms and Conditions or the rules applicable to any of the specific Experiences be declared void, ineffective, illegal or unenforceable by any competent court, regulator or authority the remainder of these shall remain in effect as if such void, ineffective, illegal or unenforceable provision(s) had not been included and where required and/or permitted under applicable law, the invalid provision shall be replaced with a provision, which closely approximates the purpose of such invalid provision

The contract between the Customer and Organizer made in accordance with these Terms and Conditions will be deemed to have been made in Luxembourg.

Any breach of these Terms and Conditions or the rules applicable to any of the specific Experience, regardless of whether the breach results in the suspension or cancellation of the Experience, shall entitle Organizer, in addition to cancel and invalidate the Pass of the infringing Consumer with no right to a refund, to claim him/her for damages caused as a consequence of said breach.

 

 

 

 

 

 

Data Protection Notice

WHO IS RESPONSIBLE FOR YOUR DATA?

All personal data submitted to us through the use of the Ticketing Platform for the Ticket purchase or your participation in the Experiences will be included in a database property of Euroleague Ventures SA, with address at 60 Grand Rue, L-1660 Luxembourg, and managed by AEG Operations GmbH, Mercedes Platz 1, 10243 Berlin, Germany; CTS Eventim Sports GmbH, Hohe Bleichen 11, 20354 Hamburg, Germany and Euroleague Entertainment and Services SLU with address at Quatre Camins 9-13, 08022 Barcelona, Spain (hereinafter, “EES”).

The Organizer is the controller of your personal data. As the responsible entity for processing your data, the Organizer ensures that the processing of the personal data you provide takes place in compliance with the provisions of the current legislation on data protection and in accordance with European General Data Protection Regulation 2016/679 (GDPR).

WITH WHAT PURPOSE DO WE PROCESS YOUR PERSONAL DATA?

The purposes of the processing will be to:

1.      Manage your relationship with the Organizer: which includes managing the Ticket purchase, post-sale service, billing and collection, fulfilment of accounting and tax obligations, execute the Terms and Conditions and inform you about the Experiences.

2.       Compliance and security control: guarantee compliance with applicable regulations and existing prohibitions, guarantee the security in the Arena and its surrounding area, including by means of video surveillance and advice and legal defence of the Organizer. 

3.      Provision of commercial communications: If you consent, the Organizer will process your personal data to send you commercial communications about products, services, news, offers and contests around EuroLeague and its official sponsors.

4.      Promotion of the Experiences: given the particularities of the Experiences, being organized as ancillary activities of the Final Four,  your image may be recorded and diffused with promotionalpurposes subject to your prior consent.

 

WHAT IS THE LEGAL BASIS FOR THE PROCESSING?

The legal basis for the processing of your personal data is:

1.      With respect to the management of your relationship with the Organizer: the processing of your personal data linked to that purpose is strictly necessary to i) comply with a legal relationship between you and the Organizer (Art. 6.1b GDPR), ii) to comply with the accounting and tax obligations (Art. 6.1c GDPR) and iii) the Organizer’s legitimate interest (Art. 6.1f GDPR);

2.       With reference to the Compliance and security control: The processing of your personal data linked to this purpose is strictly necessary in order to i) comply with the applicable legal obligations (Art. 6.1c GDPR), ii) ensure the public interest of all people who attend or participate in the Event (Art. 6.1e GDPR) and iii) the Organizer’s legitimate interest (Art. 6.1f GDPR);

3.      Regarding the provision of commercial communications: Your own consent (Art. 6.1a GDPR) and the contractual relationship derived from the Tickets purchase (Art. 6.1b GDPR); and

4.      With reference to the promotionof the Experiences: Your own consent (Art. 6.1a GDPR).

WHAT TYPE OF DATA DOES THE ORGANIZER PROCESS?

The Organizer process the personal data necessary to fulfil the aforementioned purposes, which are:

·       Name and surname;

·       State of residence;

·       Date of birth;

·       Identification document (passport for non-German citizens and ID card for German citizens);

·       Bank details linked to the credit or debit card purchasing the Tickets;

·       Email and password for account creation;

·       Image, voice and likeness; and

·       Favourite Euro League team.

You guarantee that the personal data provided to the Organizer for the purposes of the Tickets purchase is true and accurate.

HOW LONG DOES THE ORGANIZER KEEP YOUR DATA?

Your personal data will only be processed for as long as it is necessary, useful and relevant to fulfil the purposes we collected it for.

Upon termination of the contractual relationship, your personal data will be stored and properly blocked to the only effects of fulfilling the legal or contractual obligations that are of application during five (5) years or the time strictly necessary for this purpose.

Nevertheless, the data related to billing and accounting will be kept for a period up to ten (10) years from the accrual date of the Ticket purchase.

For the provision of commercial communications and promotion of the Experiences, your personal data will be kept as long as you have not withdrawn your consent. You can oppose and/or withdraw your consent for this processing at any time.

In the scenario that the applicable regulations in Germany and recommendations from the health authorities require you to have a valid COVID passport certificate or to submit a negative PCR test to access the Arena, said information will be only shown to the Experiences stewards, the Organizer will not process or store this information, nor will create a file with it. 

WHO WILL RECEIVE YOUR DATA?

We may share your personal data with public organizations, judges, courts and, in general, competent authorities when we have the legal obligation to provide them and to some third-party services providers (which may be based outside the European Economic Area) as a consequence of the provision of services.

Please note that we will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the European Economic Area and under the GDPR. Euroleague Basketball follows strict criteria of selection of service providers in order to comply with their obligations in terms of data protection and undertakes to sign with them the corresponding data processing contracts and/or if required, the standard contractual clauses, through which they will impose, among others, the following obligations: apply appropriate technical and organizational measures, use the personal data for the agreed purposes and acting only on the documented instructions of the Organizer.

CTS Eventim Sports GmbH, Hohe Bleichen 11, 20354 Hamburg, Germany on behalf of the Organizer , Euroleague Entertainment and Services SLU with address at Quatre Camins 9-13, 08022 Barcelona, Spain will process certain personal data to provide the contracted services in the role of data processors. 

WHAT ARE YOUR RIGHTS REGARDING THE PROCESSING OF YOUR DATA?

You can exercise, at any time, under the terms established by law, your rights of access, rectification or deletion of data, as well as request restrictions on the processing of your personal data, oppose its processing or request the portability of your data, by sending a postal communication to the address indicated above or by writing an e-mail to [email protected]

In any case, you can file a complaint before the National Commission for Data Protection from the Grand-Duchy of Luxembourg and/or before any other competent data protection authority.
